hat der 6. Senat (Nichtigkeitssenat) des Bundespatentgerichts auf Grund der mündlichen Verhandlung vom 7. April 2021 durch die Vorsitzende Richterin Friehe, die Richterin Werner M. A. und die Richter Dipl.-Ing. Müller, Dipl.-Ing. Matter sowie Dipl.-Phys. Univ. Dr. Haupt
für Recht erkannt:
I. Das Europäische Patent 1 956 806 wird mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland für nichtig erklärt.
II. Die Kosten des Rechtstreits hat die Beklagte zu tragen.
III. Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages vorläufig vollstreckbar.
Tatbestand

Die Beklagte ist Inhaberin des auch mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland erteilten europäischen Patents 1 956 806 (Streitpatent), das aus der europäischen Patentanmeldung EP 06 819 634.4 hervorgeht. Diese wurde am 20. November 2006 als internationale Anmeldung PCT/EP2006/068684 – unter Beanspruchung einer US-Priorität vom 28. November 2005 angemeldet und in Form der PCT-Veröffentlichung WO 2007/060147 A1 (K3) veröffentlicht.

Das Streitpatent ist in Kraft. Es wird beim Deutschen Patent- und Markenamt unter dem Aktenzeichen 60 2006 048 489.5 geführt und trägt die Bezeichnung:

Die Klägerinnen wenden zu dem Streitpatent ein, sein Gegenstand ginge über den Inhalt der europäischen Anmeldung in der ursprünglich eingereichten Fassung hinaus, und sind darüber hinaus der Ansicht, das Streitpatent sei mangels Patentfähigkeit für nichtig zu erklären. November 2020, den Hilfsanträgen 1A und 2A aus dem Schriftsatz vom 7. Januar 2021 und den Hilfsanträgen 3, 3A bis 3D und 4, 4A bis 4D aus dem Schriftsatz vom 9. Februar 2021 richtet,

Die Beklagte tritt der Argumentation der Klägerin entgegen und hält den Gegenstand des Streitpatents in der erteilten Fassung oder wenigstens in einer der verteidigten Fassungen für schutzfähig.

Die Klägerinnen rügen Verspätung hinsichtlich der Hilfsanträge aus dem Schriftsatz vom 9.
